Parte della mia attività riguarda i trasporti, spediamo camion in tutta Europa. Pochi giorni fa ho ricevuto una lettera dal Kreis Steinfurt, ne ho pubblicato una parte qui. Ho fornito le informazioni sull’autista come richiesto, quindi potremmo dire che questo caso non dipende da me, ma mi chiedo ancora come funziona in Germania.
Se ho capito bene la lettera, si afferma che il mio autista ha superato alcuni veicoli in un punto in cui i camion non dovrebbero passare veicoli ed è stato assistito (e segnalato) da un cittadino? Mi ha detto che ciò è accaduto involontariamente prima di notare che si stava formando uno Stau e che ha effettivamente superato altri 2-3 camion prima che gli permettessero di nascondersi sulla corsia di destra. Quindi è lui la colpa e deve capirlo. Ma mi sembra strano che la polizia abbia agito solo su 1 testimone oculare. Forse ne hanno un video o qualcosa del genere? Altrimenti non si tratterebbe di una situazione irrisolvibile “la tua parola contro la mia”?

As witness the Provida System is mentioned. It‘s a camera system installed in police cars (also civil vehicles) that films and documents the traffic.
Where do you get the “just 1 eyewitness” from?
Depends. Police can start an investigation on things like that, but they haven‘t to (because normal speeding, overtaking where prohibited, parking in wrong spot and so on are not considered as crimes).
Most likely police notified the owner of the vehicle about the case and they stated that either of you two drove the car. Did the other guy (the driver?) also receive a letter? I believe he was asked as witness, too. But since you stated that he drove it depends what he answered. If he also stated that he was driving, then he will receive the fine. If he stated that you drove, then it is „my word, your word“ again and police will have no power to go any further for such a minor offence.
