Ho lasciato il mio appartamento da quando ho lasciato la Germania per sempre. Mio cugino mi ha aiutato a consegnare l’appartamento poiché dovevo partire presto.
Ho mandato un messaggio al proprietario riguardo al mio deposito circa 2 settimane dopo, ma poi lei ha affermato di non aver finito di calcolare tutto perché l’appartamento era in condizioni fatiscenti, la lavastoviglie era difettosa, un po’ d’acqua perdeva nei mobili della cucina, l’appartamento estremamente sporco e un sacco di spazzatura, il che è falso. Ho pulito l’appartamento un giorno prima di partire e ho buttato tutta la spazzatura, la lavastoviglie funzionava e l’ho usata qualche giorno prima di partire. Ho scattato alcune foto qualche ora prima di partire ma non ho fatto un video della lavastoviglie. Ho potuto solo provare che l’appartamento era pulito e non c’era spazzatura. Inoltre, quando mia cugina mi ha consegnato l’appartamento, ha detto che va tutto bene, devo solo controllare se tutto funziona. Se l’appartamento fosse in condizioni fatiscenti, come ha affermato, ne sono abbastanza sicura, lo avrebbe detto subito.
Penso che stia cercando di truffarmi per i soldi del mio deposito dato che sono già fuori dal paese. Chiedo alcuni suggerimenti a riguardo.

It may be written in your contract, but usually landlords are allowed to keep the deposit for up to 6 months after you move out, and in some cases even longer. I have always waited for multiple weeks to get the deposit back.
Your cousin didn’t get in writing that everything was good?
I would immediately contact a tenant protection association before you do something that you could then be accused of. Without advice, you can quickly fall into small traps. It’s already happened to me.
When you/your cousin handed over the apartment, did she gave you an Übergabeprotokoll or anything that states that the apartment was in a flawless condition when it was handed over?
Well unless it was in the contract, you’re not going to get that deposit back until 6 months after moving out.
For the other claims I hope you have a signed handover stating everything is in good condition.
Do you have a written and signed “Übergabeprotokoll” from the Handover?

Er hat die auf der Mietsache ruhenden Lasten zu tragen.
If the dishwasher is part of the rental contract and defective, the landlord has to fix it on his costs. Unless he can prove you destroyed it on purpose or through negligence. Many rental contracts have a small repair clause, which is basically a yearly co-pay, but you pay only to the defined cap.
