Molte grazie. Potete rispondermi anche in italiano o in tedesco, devo solo capire.

  1. The sense is you can’t be in public insurance unless you fulfill the criteria which they’re asking you to provide proof for.

Yes, you need an E104 form. You either download it yourself, fill out part A and send it to your old public health insurance company in Italy. Or you call them and ask for the filled out form. They then send you the form with filled out part B, you add part A and give it to your new health insurance.

There are two ways to join public health insurance (GKV) in Germany:

    1. Mandatory membership, if you are employed and your annual gross salary is below a certain threshold (Pflichtversicherungsgrenze, currently 77,400 Euros).
    2. Voluntary membership, but this is only be possible if you have been a member of any public health insurance before, as stated in the letter: either continuously during the past 12 months, or 5 our of the last 24 months (but at least the last day before your intended join date).

The latter requirements are so that people don’t hop on and off at will – many of those who chose to be privately insured (PKV) regret it later when PKV fees increase significantly, and look for a loophole to rejoin GKV.

I don’t know much about the rules when you immigrate and join GKV, but apparently it is like this: As an EU citizen, your foreign (Italian) public insurance qualifies you to join the German GKV as a voluntary member. And this E104 form is issued by your former Italian insurance company, and serves as a proof of membership. So you must get that form from your Italian insurer, and forward it to TK.

If in doubt, just call them – they are nice, and they should be able to help in you in English, or forward the call to someone who speaks English well enough to answer your questions.

They also have offices around the major cities where you could just ask in person.

You should send proof that you’ve been previously insured to the TK (like the confirmation letter you got when your insurance with your previous insurer ended). If you don’t have those documents you can request them from your previous insurer and then send it to the TK
