    Unless I’m seriously mistaken the judge was fairly adamant that he is indeed a rapist as well.

    After the case. In which he was found on the balance of probabilities to be a rapist. He now wants to sue journalists in the same court for correctly calling him what the court called him.

    Maybe a legal expert can come in but it seems like he doesn’t have a case here; I always thought that defamation is where something is said where you’re brought down in the estimation of those who hear it, and is stated with malice and without fact.

    If McGregor doesnt like being called a rapist, then why did he rape Nikita Hand?

    I’ve absolutely no time for the man, but (unless im misremembering) i think he was found liable in the civil case for sexual assault (rather than rape). So calling him a rapist may technically be defamatory.

    Found guilty of rape, and lost his appeal in the Court of Appeals.

    He can litigate whoever he wants, it’s not defamation to call him a rapist. Even under its broad definition of a ‘perceived’ slight, it was a very public and recent case.

    Saw some folks reference the Civil Court. Not sure why it’d matter, the defamation law is about damage to character/reputation.

    Exact quote from the presiding judge:

    >The facts are clear, Nikita Hand sued Conor McGregor, a jury found McGregor raped Nikita Hand. That has been conclusively determined.

    The idea that McGregor is “technically right” because he was found liable for sexual assault is a nonsense. In order for him to be liable for sexual assault, the jury _had_ to determine he committed rape.

    It’s more likely that this is another attempt by McGregor to re-litigate the case, as the most common defence in these sort of defamation suits is that the claim they made is “substantially true”. Which Sky would have to make, and McGregor would have the opportunity to dispute. 

    Which is another opportunity for him to try and smear Hand, or present new “evidence” to the public.

    The legal system is itself to blame for these types of spurious cases.

    If they wanted them to stop they could find a way to issue serious punitive fines to those who are trying to bully people in the courts.

    Best way to get someone to stop calling you a rapist is to not be one. Being found liable for damages in Civil Court in a rape case isn’t a good look if you want people to not call you a rapist also.

    Well if you don’t want to be called a rapist, don’t rape anybody. It’s not a tough thing to do. I do it every single day and not to blow my own horn but I’m really good at it.

    But serious question, does he have any chance since it was a civil case and not a criminal case ? Is there some kind of distinction? I’m sure he has a legal team that seems to think there’s a case.

    Truth is a defense to defamation. He will have to prove he didn’t rape Nikita hand in order to win that case. Sky news lawyers will have an absolute field day. Like the legal team will be fighting over who gets to work on that case. They will give seats on the team out as Christmas bonuses

    did the verdict use the term “assault” or “sexual assault” or “rape”?

    is there a legal distinction between the latter two?

    non-irish media outlets seem to use sexual assault when reporting on the verdict
