Ciao a tutti, ho acquistato una bici da strada di fascia alta su Ricardo. Al termine dell’asta, il venditore è sembrato sorpreso che fosse effettivamente venduto e mi ha detto che non voleva davvero lasciarlo andare. Siamo andati avanti e indietro per un po’, e ora improvvisamente afferma di aver avuto un “grave incidente” dopo l’asta e che la bici non è più utilizzabile e quindi “non più vendibile”.

Faccio fatica a credere a questa storia e sembra che lui voglia semplicemente recedere dall’accordo.

Le mie domande: 1. Un contratto di acquisto su Ricardo è giuridicamente vincolante una volta terminata l’asta? 2. Il venditore può semplicemente annullare la vendita in seguito? 3. Se lamenta danni avvenuti dopo l’asta, è responsabile di tale rischio? 4. Posso insistere per portare a termine l’acquisto?

Mi piacerebbe sentire una seconda opinione o eventuali esperienze con situazioni simili. Grazie!

    The purchase is binding, both parties would need to agree to nullify the contract.

    if you waste time, you can open a case at ricardo and beyond

    Obviously, he’s lying but you should have his name and address. Why not write him that you’re still interested, even though it has crashed and you’ll be there within an hour to have a look at it – and make a plan for him to repair the bike, as it is yours now?

    I had a bad experience with a buyer myself on Ricardo… The contract is legally binding and you could take him to court, it’s definitely in your favour so it’s not a question if you will win. you should definitely threaten him with that. 

    Ricardo won’t help you at all just so you know

    Der Verkauf über Ricardo ist rechtlich bindend, Ricardo wird dir aber nicht helfen. Informiere dich bei deiner Rechtsschutzversicherung oder Anwalt über mögliche rechtliche Schritte. Vorher solltest du aber versuchen, dich mit dem Verkäufer zu einigen. Das Velo wird er wohl nicht mehr herausrücken. Vielleicht könnt ihr euch aber unter euch auf eine Entschädigung einigen. Sag ihm, dass du anderenfalls, rechtliche Schritte einleiten wirst. Das ist dein Recht. Solche Leute verdienen einen Denkzettel.

    I have more than a thousand Ricardo transactions on my name (looong time member).

    In practice, yes you have a contract. But to have it enforced, to the extent that he will sell to you at that price is almost impossible. I once asked a lawyer for an answer on that. It comes down to you not having any actual damages by the sale not concluding, so you cannot sue.

    So – if the seller is difficult, just walk away. Buy the next bike. There’s always a better deal around the corner. I love Ricardo for that. Just have some patience
