Judge Martin Nolan noted there were a “good number” of images and videos of CSAM found.

>He said the defendant lives a “very introverted and reclusive life”, adding that it is “easily understandable” that Terrobias’s offending had caused difficulty within his family.
The judge said that a precedent set by the Court of Appeal in these types of cases must be followed, which indicates that a non-custodial sentence should be considered in the absence of aggravating features such as distribution, previous similar convictions and a “very large number” of images.

>The judge said there are no aggravating features of that kind in this case and in light of the mitigation and Terrobias’ personal circumstances, he imposed a two-year sentence, suspended in full on strict conditions.

He moved over when 42. He doesn’t work. Why wasn’t he deported? Is his wife earning enough to pay for his pension privately?

Surely he’s not going to be entitled to a state pension now, is he?

And these innocent children will suffer the rest of their lifetimes. How is this ok? There needs to be a serious change in Irish laws to stop people like him getting away with this. It’s like saying children don’t matter??? WTAF is wrong with this country.

D is for Deport.

As I pointed out in a previous post- the judge said that a precedent set by the Court of Appeal in these types of cases must be followed. Implying that his hands are tied to an extent.

While I still believe the court of appeal allows some wriggle room, it really now falls to the legislature to bring forward legislation to deal with these crimes.

The primary function of the TD’s we elect is to legislate. They are demonstrably failing in this duty year after year- often citing time constraints and failing to get through Daíl business .

I’d argue, that if they spent less time grandstanding on fringe issues and activism, often beyond their control or remit- and more time on legislating then they would garner more respect and the country would be a better place for it.

Legal lacunae such as this, are a case in point.

I raise this with any politician I happen to meet, which isn’t many to be honest. I’d urge others to do the same.
