Ho già scritto in precedenza riguardo al fatto che sono stato accusato di furto e violazione del contratto dopo aver chiesto il pagamento per il mio lavoro. Il che è falso.
Ho inviato una risposta sostanzialmente per contestare le accuse e chiarire la situazione. Ho allegato una prova e anche le fatture. Ma ovviamente viene ignorato. E la scadenza della fattura è passata.
Oggi ho inviato alla persona un Mahnung e lei ha risposto rapidamente ma ora ha intitolato l’e-mail: Betrug. Ed ecco la risposta. E l’ultima frase menzionata diceva:
"Mandami la fattura e sarò felice di trasferirti direttamente 50 Euro"
Da notare che la Mahnung riguarda 2 fatture per il lavoro di ottobre, mentre sembra che si stia concentrando sul lavoro di gennaio (dove nascono le accuse e lei menziona 90 euro, perché quel giorno ho lavorato meno ore).
Non so se dovrei semplicemente rispondere qualcosa del tipo: non sono d’accordo con la riduzione, poiché non siamo in grado di raggiungere un accordo, perseguirò la questione legalmente.
Quindi attendere la scadenza della Mahnung per andare oltre. E onestamente non ho i mezzi per fare l’avvocato di tasca mia. Da ChatGPT dopo la scadenza del termine Mahnung posso presentare un Mahnverfahren.
Non so se ne vale la pena, è vero che sarà così costoso (non solo la paga iniziale dell’amministratore di circa 40 euro, che anche l’altra parte pagherà se vinco la causa), e c’è la garanzia che riceverò i miei soldi dopo aver attraversato tutte quelle procedure legali.
Qualcuno ha esperienza nell’affrontare azioni legali come Mahnverfahren e simili e potrebbe riavere il tuo stipendio?
Tieni presente che qualunque accusa sullo screenshot che ho allegato non è vera. E non rivelo qui il dettaglio per non rendere il post troppo lungo.
Mi sento solo un po’ insicuro perché sono un’agenzia, presumibilmente hanno più soldi e contatti e probabilmente hanno inventato cose per farmi causa. Mentre io sono solo una persona normale senza backup.
E no, non voglio usarlo come "esperienza di apprendimento e ridurre le mie perdite"ne ho abbastanza. Ho bisogno dei soldi, fino all’ultimo centesimo, per pagare le cure del mio cane.

For 40 Euros? Like if i understood it correct, you want 90 Euro and she claims you stole a “big pizza” and sweets and that means you only get 50 Euro. If i were you i would just take the 50 Euro and move on. It doesn’t really make sense to pay a lot of money to some lawyer only to maybe win 40 Euro. Or is there more money involved in this? And i know you wrote you need every cent but as i said, it makes no sense to pay a lot of money to a lawyer for winning 40 Euros.

But the accusations with theft also has no base.
Because the food is PROVIDED by workplace, for everyone that works on that day to consume freely on the break room.
So EVEN IF I consume the food, it can’t be charged to me.
And the thing is I didn’t consume the pizza AT ALL, only a few candies.
So who the heck wants to pay something that is actually provided by work.
And also, please read the post that I mentioned more than one invoice. So the money is more than 90 Euro
I’ll be blunt here.
A lawyer for 400€ isn’t worth it at all. Don’t be an idiot, you are wasting your time.
They know their position of power, they won’t give in. This will take months or even years.
I’d rather recommend to focus on getting a proper job and leave it the f be.
