It’s important to note this isn’t a statement by the court on the morality of the action nor does it dispute that the phone was either grabbed or knocked out of her hand, as the BBC article notes.
The problem that’s lead to this being overturned is that there is no contemporary evidence on the state of the phone.
They cannot establish that it was damaged as a result of his actions because it could have been damaged beforehand *or* by somebody else in the 19 days between the incident being reported and damage to the phone being separately reported and confirmed.

I do wonder if there’s any extent of hatred or abuse towards transgender people that is actually illegal anymore. It is very interesting to see the Governments correct response to the antisemitic incident in Golders Green this week, and how they’re committing to protect Jewish communities, compared to the response that has occurred since the transphobic murder of Brianna Ghey a few years ago, and how they’ve actively tried to force trans people out of public life and how they’re enforcing conversion therapy on trans children since. It’s pretty fucking grim.

She should sue him in small claims court for it, there you only need a preponderance of evidence that he damaged the phone.

17-year-old girl, a teenager at the time, Graham Linehan is a 55-year-old man who spends all day posting slurs and insults at random trans people he can find online and physically assaulted this girl. The degree of coverage for his actions is truly absurd. It’s like one of the few things all society agrees you don’t do, unless you’re a favoured court jester bigot to the press and the subject of your assault is trans, I suppose.
