So, my grandmother passed away 2 years ago and left me her house in her will. However, nobody did anything at the time, so the house still belongs to her in the public registry. I was 16 years old when she died and couldn’t go to a notary and the Public Service Hall myself to change the registration to my name. Now that I am 18, I went to a notary, and he processed all the documents based on the fact that I have actually lived in the house since she passed away, rather than based on the will (ანდერძი). My father and uncle wrote a paper refusing the inheritance, so there is no problem now, the house is officially mine. But my question is, technically, if my father, who lived in Turkey the whole time and sent us money to live, hadn’t refused the inheritance, could he have claimed in court that he took actual possession of the estate? Could he have taken the home trom me completely, or at least 1/4 of it? In Georgia, is “actual possession” (ფაქტობრივი ფლობა) determined by who physically lived in the house, or can it include someone who paid for the family’s living expenses without residing there?
Also, one important detail: my uncle actually didn’t sign a formal waiver. The notary told me it wasn’t strictly necessary since my actual possession was already legally established. Right now, my uncle is completely in the dark because he believes the house was transferred to my name while my grandmother was still alive, and he doesn’t know how to check the public registry.
This brings up two more questions. Theoretically, if someone tells him the truth later on, could he resurface in, say, 5 years and claim his 1/4 share through court?
And can I safely sell the house now? If he finds out after I sell it, could a court annul the transaction and force me to refund the buyer? What kind of legal trouble could I potentially face in that scenario?
When purchasing real estate, are many foreigners taken advantage of? If so, in what ways do you see it happening and how good is the legal system at resolving disputes fairly (i.e. no advantage to locals / developers over foreigner individuals)?
If i am married to a georgian woman (as a woman) am i recognized as her wife in georgia?
