Sleeping on that mattress.” The suspect was also Iwona’s partner and, on paper, her employer: An employment contract stipulated that she maintain the house, garden, and kitchen in exchange for a salary. According to the mother, however, Frei never paid her a salary and only covered her living expenses. When Iwona L. applied for social welfare from her municipality of Untersiggenthal after Frei’s arrest, the municipality reported the case to the cantonal migration office. The reason: The employment contract could have been a sham arrangement designed to secure her right to stay in Switzerland. The office had the cantonal police investigate the matter and later ordered her deportation: If the mother and daughter do not leave Switzerland voluntarily, they face forced deportation.

“No Serious Personal Hardship”

The allegations of sexual assault, the office wrote in its ruling, could not constitute a “serious personal hardship.” Furthermore, the municipality paid the women only a reduced emergency relief of about 1,000 francs per month instead of the standard monthly rate of about 1,600 francs, citing the fact that their residency status was currently under review. Experts interviewed by Swiss media consider this procedure unlawful or at least questionable. A social law jurist interviewed by the Tages-Anzeiger sees no legal basis for the benefit cuts. Marc Spescha, professor emeritus of migration law, calls the deportation a serious administrative failure: As an EU citizen, she would have had a right of residence even without an employment contract. The case law of the Swiss Federal Supreme Court requires special protection for migrant women who have become victims of domestic violence.
