Il 30 giugno il mio padrone di casa mi ha inviato una lettera via email per avvisarmi di aumentare l’affitto. Questo è all’interno del documento da firmare (le informazioni di contatto sopra e la firma sotto sono ovviamente ritagliate). L’e-mail stessa contiene questi frammenti, che presumo parlino del ragionamento:

    Secondo la sezione 558 comma 1 del Codice civile tedesco (BGB), il locatore può chiedere il consenso ad un aumento del canone se il canone è rimasto invariato per almeno 15 mesi. Questo è il caso nel tuo caso perché non c’è ancora stato un adeguamento dell’affitto di base e il contratto di locazione è stato concluso quasi 2,5 anni fa.
    Inoltre ai sensi dell’articolo 558 comma 3 del Codice civile tedesco (BGB) è consentito un aumento fino al 15% entro tre anni (limite massimo per la città di Monaco). Anche tenendo conto di questo limite superiore legale, l’adeguamento previsto di solo il 14% mi pone al di sotto del limite consentito dalla legge.
    L’adeguamento si basa, tra gli altri, sui seguenti fattori:
    – Sviluppo degli affitti comparativi locali a Monaco di Baviera, che sono significativamente più alti dell’affitto attuale
    – Aumento generale dei costi nei settori della manutenzione, dell’energia e dell’amministrazione
    – Accrescimento del valore dell’immobile attraverso continue cure ed interventi volti a preservarne la sostanza
    – Adeguamento al livello generale di locazione di immobili comparabili in luoghi e strutture comparabili
    – Gli affitti sono rimasti invariati da molti anni nonostante la crescente domanda sul mercato immobiliare di Monaco

    Cosa ho fatto finora e le mie preoccupazioni:

    1. Ho chiesto ai colleghi del mio ufficio e mi hanno detto che avrei dovuto provare a chiedere una Mietberatung al Sozialreferat Amt für Wohnen del mio comune. Mi richiedono di compilare un Wohnungsbeschreibungsbogen, di cui non posso riempire alcuni campi, di solito quelli legati al tempo come "l’ultima volta che è stata rinnovata la pavimentazione"quindi ho chiesto al mio padrone di casa di aiutarmi a riempirlo. Mi ha risposto che l’indice degli affitti non si applica al mio appartamento quindi non posso ottenere aiuto da Sozialreferat, motivando questo:

    L’appartamento che hai affittato presenta alcune particolarità che, a mio avviso, non rientrano nell’indice degli affitti. Tra questi rientrano, tra l’altro, la tipologia di locazione come appartamento ammobiliato nonché altre caratteristiche specifiche dell’appartamento, che nel complesso non consentono un confronto diretto con gli appartamenti registrati nell’indice degli affitti.
    L’indice degli affitti è uno strumento statistico sviluppato per uno stock di appartamenti precisamente definito. Pertanto non è immediatamente applicabile ad ogni appartamento. La registrazione di un appartamento dipende da diversi requisiti che devono essere considerati nel contesto. Per questo motivo purtroppo non è possibile rispondere alla domanda con un solo esempio o con un criterio isolato.
    In questo contesto, l’aumento dell’affitto da me inviato non si basa su una classificazione secondo l’indice degli affitti di Monaco, ma su una base generalmente consentita.

    Dovrei fidarmi che il mio appartamento sia davvero fuori dall’indice degli affitti? Il Sozialreferat qui potrebbe aiutarmi comunque o dovrei ora prendere in considerazione l’idea di unirmi a un Mieterverein?

Mi capita di leggere un post simile quie, se ho capito bene, se il mio alloggio è davvero fuori dall’indice degli affitti, dovrebbe essere in grado di mostrare l’affitto di riferimento locale su altri appartamenti, giusto? Premesso che i suoi numeri sono giustificabili per legge, credo (nessun aumento dell’affitto in 2,5 anni, e del 14% ora) e conosco un altro collega che vive nello stesso edificio del mio con la stessa stanza, e il suo affitto è già 985, ma dovrebbe comunque mostrare le prove, giusto?

Senza tutto quanto sopra, so già che la sua scadenza è di 1 mese troppo breve, l’e-mail contenente "Ai sensi del § 558b BGB vi chiedo di accettare l’aumento dell’affitto al più tardi entro la fine del mese secondo mese dopo aver ricevuto questa lettera" e non zwei Kalendermonat come dice effettivamente il § 558b BGB. Quindi ho sottolineato che ho un mese in più di scadenza per riconsiderare la questione (fino alla fine di agosto). Non ha risposto quindi non so cosa stia tramando. Adesso non ho ancora alcuna assicurazione legale e se ne prendessi una o mi unissi immediatamente a Mieterverein, penso che dovrei aspettare ancora 3 mesi prima di poter utilizzare i servizi legali. Può davvero sporgere denuncia, sfrattarmi o fare cose dannose da cui non posso difendermi a questo punto?

    Scusate per il post lungo, speravo di poter passare tutti i dettagli importanti qui.

      Not a lawyer. My understanding: Their reasoning is insufficient. They need to provide the prices of comparable apartments.

    2. So even you know that your rent actually is cheaper than the others but you are still trying to fight the landlord over semantics?

      If they ask for your permission to raise the rent, you don’t have to grant that permission.

      So don’t sign it and wait.

      You have 2 months to think about it anyways. If they think they have a case they could technically sue you but they can’t kick you out. If you lose you would have to pay the higher rent.

    4. Your landlord seems to know well what he’s doing. His arguments are not obviously unreasonalble, although you could always find a point to have doubt. The cases where Mietspiegel is not applicable (most often due to renting with furniture) are always difficult. I would not risk being sued without an existing legal insurance – it is not sure you loose but also not probabale you can fully win. Next time be smarter: be already in a Mieterverein or a legal insurance and you could fight something like that. In the case you don’t want to sign anyway, join a legal insurance with only 1-month waiting afaik. Worst case he dismisses for personal use of the app, then you would also need legal advice.

      For the time you have left: He didn’t respond to that so you can of course use the statutory deadline.

      Based on your screenshot, this is not a normal “Mieterhöhungsverlangen” but an addendum to your contract for a consensual (!) rent increase.

      If you are signing this you are agreeing to the new rent and the conditions mentioned in the letter no matter if the increase is justified or not.

      Do not sign this.

      A regular request for rent increase is exactly that, a “request”. There are two ways to accept the request:

      * by signing an acknowledgement and/or
      * by paying the new rent from the 3rd months after receiving the request.

      If the request is valid but you do not agree, the landlord has to sue (and will win!).

      Now, maybe your landlord is just a bit of an idiot and they may increase the rent but just ignore the “HOW IS IT DONE THE RIGHT WAY?”. Based on their answer to your question they know exactly what they are doing and are trying to bend the law a bit.

      First of all, it seems you are renting a fully furbished flat/apartment. In case of furnished properties the overall rent is split in two parts, the “base rent” which is bound to the rental control (Mietspiegel) and the furniture surcharge.

      The former can be raised according to the law, the latter on the other hand can’t.

      Now the tricky part, usually the landlord does not have to itemise the rent and how much the furniture surcharge is unless you suspect foul play. That’s because the surcharge is not a random number but is based on the fair value of the furniture and also what kind of furniture they provided.

      Examples:

      A room with just a bed and a night lamp does not count as “fully furbished”.

      A fully furbished flat with 20 year old rubbish furniture does not validate a huge rent increase.

      Your landlord already fucked up the deadline. Based on this alone the document is invalid and you can safely ignore it. However, a friendly worded e-mail/letter (no whats app or verbal) goes a long way. You don’t have to tell them what they did wrong, just that you won’t accept it.

      In the meantime:

      * Check your tenancy agreeement again.
      * Check your local Mietspiegel and figure out what your local reference rent for your apartment is.
      * Make a list of the rented furniture and try to appraise its time value. Just eyeball it. If push comes to shove the landlord has to disclose it. Careful with kitchens if they are mentioned in the Mietspiegel and are being used in the calculation for the base rent, they cannot be part of the surcharge, too.
      * Get legal help from the local [Mieterverein ](https://www.mieterverein-muenchen.de/)or the Sozialreferat.

      Don’t sign anything, don’t help your landlord fixing their mistakes, get help.
