Ma per l’ultimo anno la nostra agenzia immobiliare ci ha fatto pagare per questo. Ci hanno anche mandato una bolletta e tutto il resto. È legale?

    2. It says “WG” as the first line of the recipient of the letter. Is this a single rental contract with multiple tenants on it? If so, the landlord isn’t even obliged by law to agree to exchanging a tenant in the first place. The only options without the landlord’s voluntary consent are

      * the parting WG member remains on the contract and sublets to their successor
      * the entire lease is dissolved (which requires the consent of every WG member), and a new rental agreement is made between the landlord and the new collection of WG members (possibly along with a rent increase)

      There are instances in which courts found fees for exchanging tenants illegal (because vetting tenants and making and changing rental contracts is considered management of the property, and therefore can’t generally be charged to the tenant, especially not by means of a pre-agreed flat fee in the rental contract), other instances where they found them legal (and I don’t fully understand what was different in those cases).

      If you are a member of a renters’ association, go and ask *them* to check the validity of the fee. If you are not, you should thoroughly consider whether it is really worth consulting a lawyer over 35 Euros. You may also want to consider joining a renters’ association now, especially if you expect further disagreements. But do check whether they cover disputes that started before you joined.
