Ho bisogno di un chiarimento sulla politica relativa ai congedi per malattia e se qualcuno ha avuto un’esperienza simile.
Il mio contratto stabilisce chiaramente che la richiesta di congedo per malattia deve essere presentata il giorno successivo al secondo giorno lavorativo di assenza.
L’azienda ha adottato una nuova politica in base alla quale il datore di lavoro è tenuto a presentare un certificato di malattia rilasciato dal medico fin dal primo giorno, con decorrenza immediata.
La domanda è: è consentito farlo senza cambiare i contatti?

2. “ohne Aufforderung spätestens an dem Arbeitstag , der auf den zweiten Tag der Arbeitsunfähigkeit erfolgt” – “without request at the latest on the working day following the second day of incapacity for work”
Your employer now requests immediately. This is effective, since it’s already in your contract.
The Paragraph says in the beginning “unverzüglich” which translates immediate, and only when nothing was asked for, latest after the second day of beeing sick.
The first sentence says distinguishes two cases. If the empolyer requests it, the sick leave must be submitted without undue delay. Without a request, the sick leave must be submitted the day that follows the second working day of absence.
The employer now generally requests the sick leave notice, kind of a standing order.
