Ciao a tutti, affitto una stanza in un WG con il proprietario da gennaio 2024. Nel contratto abbiamo un periodo di preavviso di un mese. Dato che sto viaggiando già per un paio di mesi a partire dal 21 aprile, ho presentato in tempo la disdetta e abbiamo concordato per iscritto che il contratto sarebbe scaduto il 21 aprile e che avrei pagato un importo ridotto di affitto per il 21 giorni in cui rimarrò ad aprile. Il contratto prevede che l’affitto debba essere effettuato l’ultimo giorno del mese precedente. Per il mese di aprile, ho effettuato il bonifico come al solito l’ultimo giorno del mese (31 marzo), tuttavia a causa di qualche problema tecnico in banca, il denaro è arrivato oggi (2 aprile). Ieri sera (1 aprile) l, il proprietario mi ha inviato un’e-mail dicendomi che ho violato il contratto e che mi prenderà due giorni di affitto dal deposito e che devo traslocare oggi (2 aprile). Ho risposto alla sua email chiarendo la situazione e ho inviato uno screenshot dei dettagli della transazione e che il pagamento è stato effettuato negli ultimi giorni e c’è solo un ritardo insolito da parte della banca. In pratica mi ha risposto che non gli importa e che ho violato il contratto e che avrei dovuto pagare in contanti o fare il bonifico prima. E che mi avrebbe rispedito i soldi dell’affitto. Secondo la mia banca il bonifico dovrebbe arrivare oggi. Cosa dovrei fare ora? Ho davvero bisogno di andarmene oggi, qual è la migliore linea d’azione? E come posso assicurarmi che non trovi scuse per trattenere la caparra? All’inizio non abbiamo fatto una valutazione ufficiale della stanza, ma il giorno in cui mi sono trasferito ho scattato alcune foto dei graffi sui muri, ecc., il che probabilmente non è abbastanza! Questo è un periodo davvero impegnativo per me e non voglio davvero avere problemi con questo e non voglio nemmeno finire per pagare un sacco di soldi in avvocati per questo! Violated contract or not, you can’t be kicked out with hours notice. Even if you didn’t even send the money at all – let alone if there was a day or two delay in receiving funds due to holidays and weekend.
Look up the local Mieterverein and ask them for help. Also make sure to become a member if you already haven’t.
If your landlord tries to kick you out by taking your stuff or similar you’re free to call the police.
Even if someone doesn’t pay rent *at all*, that isn’t sufficient reason for being evicted that same day. Eviction takes at least two months of non-payment.
But crucially: You *did* pay your rent on time. The law says that the money needs to be in the landlord’s account on the third working day of the month. This month, that would be the 4th. It’s normal to have your bank transfer set up for the 1st, and for the money to arrive on the first working day after that if that’s a Sunday or holiday.
Do *not* move out. Talk to the Mieterbund in your location.
If he tries anything just call the police and explain the situation
I think:
A Kündigung needs to be a letter. An Email is not enough.
The rent is due on the 3rd of the month (BGB). (the day you send it, not the day it arrives)
He can only give you a fristlose Kündigung, if you havent paid your rent for two months.
Yesterday was a holiday. It was not possible for you to pay the rent on April 1st. Today is the first bank working day of the month. It is perfectly fine that the rent is paid today.
I wonder if he has a tenant ready to move in now, so he can collect double rent for 3 weeks
The max he can suggest for a late payment of rent (which is not the case here imo) can be charging a late fee but definitely cannot be kicking you out in under 24 hours notice and via email.
Cease direct contact after mentioning that you’ve contacted a lawyer and he will contact him. Call the police if he/she harasses you further.

That’s all nonsense what your landlord tells you. Before you get a lawyer. There is the Mieterverein or Mieterschutzbund. If you joining them for a small fee, there are give you advice how to proceed.
Btw there where no technical issues with the bank. The 1 April was a bank holiday your bank and also his bank didn’t work. What did he expect? He just try to squeeze money out of you, because you are leaving. Maybe he is mad that he has to search for a new tenant after 4 Month.
You can’t be evicted like this in Germany, so you have time to plan your exit
Others have told you that this is hogwash.
I want to add, however: If he forcefully tries to actually put you on the street, threatens you or similar things you can and should call the emergency line of the police. They will set him straight.
Unfortunately, I had to do this myself once. It is a completely nerve-wracking experience, but you will be helped.
