Kicking someone in the head while on the ground. If they die it sotos be straight up murder.
If they don’t die. It should still be attempted murder.

Kicking a lad in the head while on the ground is the same as using a knife in my view, you can’t genuinely say you didn’t mean to kill him, it was a likely outcome and you made your choice. I’m not 100% sure about two murder charges though, fights happen, but ultimately one guy hit the blow that killed him. It’d be different if they both did and you couldn’t tell who was responsible.

The lads jumped in to an altercation that was already happening when passing as the victim and his dad were being thrown out of the pub is that it? Hard to say what exactly went on but that was what I’m getting from reading a couple of reports on this.

Mens rea for murder is not simply intent to kill. Intent to cause serious harm is sufficient together with an act of killing to justify a murder conviction.
Actions committed in self defence should not exceed force deemed reasonable in the circumstances.
I would be very interested to see the footage of the initial incident. However, I can’t see any jury holding the running kick did not satisfy the criteria for murder. Will be keeping an eye on this one for sure.
