Pay your bill.
Pay the fine.
The punctured tires are a different story. They should be a Sachbeschädigung. But they have nothing to do with the fine you need to pay.
there is no way you get out of paying this fine if it is legit.
you can try to fight it in a lenghty legal battle. but it is just not worth for 300€ in my opinion.
Take the L and leave it.
Tha fact that someone punctured your tires does not affect any of the fines you have to pay for the removal of the car.
I mean, they vandalized your car, so I’d report that to the police, but if that was 3 years ago i’m sure thats a bit late to do anything about. Otherwise yeah they towed your car and fined you, so yeah you need to deal with that. If it was towed solely because of the punctured tires, then that might have been something to deal with, again, 3 years ago.
it could be that the deadline to issue a fine has expired. The google term you may want is “Bussgeld Verjährung.” Some fines expire if notice isn’t issued within 3 months of the date of the offense. Obviously 3 years would greatly exceed that, but there are details which matter. Other actions can postpone that deadline, so you’ll need to see the details for yourself.
I would google that, and if it seems like it meets your case, then you might contact a lawyer to see about challenging the fine.
Typically, fines must be issued within 3 months; otherwise, they expire. However, the letter explicitly states that this is not an administrative offense but rather a measure to maintain order at weekly markets, and the statute of limitations here is 4 years.
Legally, you’re required to pay.
But it’s really strange that they’re only bringing this up 3 years later.
Pay your fine. Yes, it might be uncomfortable, but having it escalate to Gerichtsvollzieher or even Zwangspfändung, because you didn’t pay.
The slashed Tires and the Police are two seperate Things you can tackle in your Own Time. This Bill? Nope, pay it dont forget it.
Must be a scam, verify with the authorities first
If you reported that your tires were slashed at the time, could this be a justification for not moving the car right away? How about you didn’t want to tamper with a crime scene?
I mean, you have only one spare, right?
I know it seems like a stretch but I’d personally use any excuse I could as long as it didn’t involve legal fees.
How do you know that the guy from the market stabbed you tires in the morning and not someone else during the night?
The police wouldn’t know either, so how should they report it.
