Whether there’s abuse or not depends on the details.
The roads and pavements can be in very bad condition so it’s not always unreasonable.
I’ve seen potholes on bike lanes so big they’d probably break my wheel and me with it
County Councils cannot be sued for poor maintenance of roads and footpaths, due to the rules on misfeasance and nonfeasance. So they only have to pay monies out when they’ve properly made a dogs dinner of something if it relates to a road or footpath.
Checks out, it’s an average of just under 12 thousand per claim. When you think this includes tree damage and vehicle damage etc. If the council was negligent then they should pay out. Also just to say in Ireland we’ve a high amount of liability as our regulations are high but our pay-outs for falls etc tend to only just pay for the damages and tend to ignore mental trauma. I’ve seen pay out vs injury lists out there and the vast majority of it isn’t worth it at all.

It’s near impossible to sue councils for poor road maintenance, there is a legal distinction drawn between misfeasance and non-feasance. The councils likely messed up, badly.

When I’m abroad, I don’t see anything like the same level of care we have here, I see broken paths, holes where people are working, potholes etc. Why do we pay out so much?
