Ciao a tutti, aiutatemi 🙁

    Sono un consumatore di cannabis ormai da molti anni e ho iniziato con la cannabis terapeutica poco prima che fosse legalizzata in Germania. Come dice la lettera, mi hanno fermato mentre tornavo a casa il 24 novembre e mi hanno testato per il THC e beh, è ​​risultato positivo. Poi mi hanno prelevato il sangue per gli esami e, un paio di mesi dopo, ho ricevuto questo.

    Al momento non avevo con me la ricetta, ma ho mostrato loro la documentazione che avevo con me in quel momento, ovvero un referto medico del medico che mi ha prescritto la cannabis. L’ultima prescrizione che ho ricevuto risale a due mesi prima che ciò accadesse.

    Durante l’intero processo mi hanno fatto anche molte domande, alle quali ho risposto in tutta onestà, in modo innocente, e sembra che lo stiano usando contro di me. Ho anche un vaporizzatore, che al momento non avevo.

    Ho anche tutti i referti medici che ho presentato al medico che mi ha prescritto la cannabis.

    È molto brutto? Qual è il modo migliore per gestire questa situazione e cosa viene dopo di solito? Qualsiasi aiuto sarebbe apprezzato. Se hai bisogno di sapere altro, chiedi pure.

      You do as they say. You get this to your doctor make him write down all the answers to their questions including proof and wsit for their “Einzelfallentscheidung”
      Worst case they will suspend your license and you have to do a MPU

      does that matter? as far as i know it’s illegal to drive a car while you’re under the influence of a drug like cannabis. it does not matter if it’s prescribed or not, **you are not allowed to drive a car**.

      the case is pretty clear, time to lawyer up but you should have done that months ago to be honest

      I can only recommend a lawyer for traffic law (Lawyer Nissen in Moabit). It looks like you have to do a medical psychological examination which costs a lot of money. 5-8k

      Yeah, answering questions was a serious mistake. I don’t know if you can still contest anything, but maybe ask a lawyer. Anyway this is going to be very costly for you. Getting your license back/not revoked in the first place isn’t going to be cheap. Expect somewhere in the “a few thousand euros” range.

      Even if you’re consuming medical cannabis you’re not allowed to still drive with THC in your blood, which can sometimes take multiple days for your body to get rid of. So I guess this will hold in court. But again, ask a lawyer.

      Just do what they ask of you? That letter says that they’re not sure how much your driving skills were impacted by your drug useage, so they need additional information. We can’t tell you how they’ll decide once they have that information.

      Find yourself a lawyer who deals with Fahrerlaubnis and you might have an easier ride…. Still going to cost you, mind.

      Alright, what’s done is done, but ffs hammer it into your heads, people: do not talk with cops. Nothing to gain, lots to lose. Let your lawyer do the talking, if and when the time comes. Don’t have one? Get one. Now. Don’t have the money? Go to your local *Amtsgericht,* bring everything documenting your financial situation and apply for *Beratungshilfe*. A *Rechtspfleger* will then proceed to check if you’re entitled to having your lawyer costs covered by the state. Because yes, you’re well and truly fucked. At least insofar your licence is concerned. This is gearing up for a full-scale *Medizinisch-Psychologische Untersuchung (MPU)* and just providing a prescription won’t cut it. They’re already asking for documentation on your compliance with therapeutic plans. You will have to fight this in court, if you plan on continuing to drive. Which will be an uphill battle, but there is a chance. So chop chop, get on with it quick like a bunny and get yourself a lawyer first thing tomorrow morning.

      Firstly, yes, you’re probably fucked and that’s a good thing. Driving under the influence of drugs is an absolute no-go, even if prescribed by a doctor.

      Secondly: have fun on your bike and on public transport 😉

      They wrote, that your Rx stated you’d consume medical cannabis through inhalation and the use of a vaporiser.. but you didn’t said a word about it..
      You talked about your cannabis use.. major red flag. Never talk to the cops. It’s their job to get evidence not yours to provide it.

      Get yourself a lawyer and don’t talk to them without legal advisory.

      A prescription doesn’t change anything about that.
