Ciao a tutti, vorrei chiarire se la terminazione data non è chiara per me ed è colpa mia o è la clausola di terminazione effettivamente confusa.
Vivo in un WG con altre 2 ragazze. Questa è la parte, abbiamo davvero pensato che possiamo partire alla data di fine con un preavviso di tre mesi. Ad esempio, sarei in grado di partire il 31.08. 2025 informando 3 mesi prima del 31.08.2025
Si scopre che non possiamo partire fino al 31.08.2025, possiamo inviare un avviso di risoluzione solo dopo il 31.08. 2025 e soggiornare nei prossimi 3 mesi settembre, ottobre e novembre.
Le altre 2 ragazze erano anche confuse quando furono informate dal proprietario che non potevano andarsene.
Siamo tutti studenti e nessuna della nostra prima lingua è tedesca. Inoltre, il proprietario non è facile da comunicare, è facilmente infastidito e parla in modo molto schietto, in modo sprezzante quando viene chiesto qualsiasi domanda.
Il proprietario ha anche promesso un paio di cose attraverso la nota vocale che non ha mai realizzato.
Pensi che il contratto sia abbastanza chiaro ed è nostro colpa non capirlo o con le leggi tedesche il contratto non è chiaro e quindi come compensazione che possiamo lasciare alla data di fine.

It is clear and valid.
31.08.2025 is the first date on which notice of termination can be given. This means that it is the earliest possible last day of the tenancy, provided it has been terminated in due time.
The clause does NOT mean that notice of termination can only be given from this date. In short: the landlord’s statement is wrong.
The best thing to do is to go to the AStA of your university and ask for help, they usually offer advice on legal/rental issues.

Basically means if you consider the notice period (usually three months) you the earliest termination date is 31.08.2025. Thus: your landlord is wrong, and you are right.
If you already send your written termination, you can move out on this date. It does not matter, that your landlord does not agree. His reaction proves, that he received your termination notice. You wont have to pay more rent after this date.
Be aware: If you move out as you planned and are allowed to, your landlord will likely withold your security deposit. He will claim he’s in the right and so on… Best thing to do, is to already join a Mieterschutzbund, so you will have help, as soon as you need it.
