Ho capito correttamente? Potrei andare in ospedale o clinica ed essere curato da un uomo che ha violentato una donna che era probabilmente incosciente o almeno vulnerabile? Il giudice ha riconosciuto che ciò che è accaduto è stato stupro ma ha scelto di non imporre alcuna punizione perché l’uomo lo è "giovane e talentuoso."

    Questo giudice sta dando la priorità al futuro dello stupratore sul trauma della vittima e alla sicurezza delle altre donne?

    Questo tipo di sentenza accade spesso? Sto davvero cercando di capire.

      Rape is definitely not taken as seriously as it should imo. But let’s not act like this is only an issue in Belgium. A lot of (Western) countries are quite lenient.

      I’m sure the raped vicitm is still in shock and by not letting the criminal be charged, she probably thinks she will have a better time healing.

      But that will backfire for sure.

      So yes, I totally agree with you that this is an incredibly light slap on the wrist for a person that will have a job where ethics should be sky-fucking-high. But apparently even the victim is satisfied with this outcome, somehow?

      Still, the fucker deserved to have “difficulty finding a job”. God damn…

      It seems not. Just like drunk driving isn’t.

      And it’s a judge problem. The laws allow for much stricter punishment, but judges seem give people way too many chances for some reason… I get there is no need to completely ruin someone’s life for a misstep. But rape (very likely aided by the use of narcotics), isn’t a misstep anymore. And not allowing someone to become a doctor isn’t ruining their life.

      Just look at the entire reuzegom situation and decide for yourself whether we have a class difference or not.

      If you’re wealthy or influencial enough you get away with literally anything, including rape. Tale as old as time.

      A combination of leniency (which is an international problem: in the West punishments are too low, in other regions the definition of SA/rape is much more narrow and everywhere actual arrest rate is abysmal) and good old classism which has been shown to still be very much a thing in our country.

      In this particular case the VICTIM ASKED THE JUDGE to not give him a punishment, as she mainly wanted recognition and guilt that it happened, not ruin his life, as stated in the article later.
      some news sites purposely change headlines to gain clicks and (abysmal behaviour from those who do so, a threat to objective journalism)

      However, in many rape cases the punishment is in no way enough in my opinion , and the justice system in general is a joke, ever since M.D did his shit and the police reforms, nothing has changed unfortunately: the case of Santa Dia and Van Espen are painful examples of this today.

      Another example: buddy of mine drank too much, drive home drunk and did a hit and run on a dead biker. Sentence? A year in prison. His ACTUAL punishment? 9 months with a ankle brace, because new laws state any >5 year sentence isnt mandated because overpopulation of prisons

      I’m usually the first one to trust and defend judges but this is a very wrong ruling, especially from a moral standpoint. It’s unfair towards the other medicine students who do respect consent.

      I think there is a big disconnect between the stuff the public expects and what the government/judges actually deliver. If you talk to an ‘average’ person on the street they would probably want rapists locked up for life, but the reality is that there is no space in prisons, and judges + government are apparently unwilling to try and solve this (for example, more prisons, lesser sentences for drug crimes, more psychiatric care etc…)

      (Disclaimer: Geen uitspraken over de soecifieke zaak, de feiten zijn complex en niet aan mij gekend.) Het is gemakkelijk om rechters te veroordelen.

      M.i. ligt het probleem evenzeer bij de academische positie. Aan onze universiteiten is de algemene opinie dat mensen straffen meestal niet helpt en al zeker niet mensen in de gevangenis steken. Over het algemeen is de focus verschoven van straffen naar iemand begeleiden zodat die terug kan deelnemen aan het maatschappelijk leven.

      Rechters zijn geen lege vaten. Die zijn doordrongen van hun opleiding en de opinies van hun peers. Even goed proberen zij hun vonnissen zo goed als mogelijk in overeenstemming te brengen met wat in de wetenschap als goede vonnissen wordt beschouwd.

      Je kan kritiek hebben daarop en zeggen dat rechters tegen de stroom moeten ingaan, maar dat is nu eenmaal niet de aard van een rechter. Ik denk ook niet dat we in het algemeen zo’n rechters willen.

      Ik vrees dus dat het probleem vooral bij onze universiteiten en de opleiding ligt. Zolang daar wordt verdedigd dat straffen slecht is, zullen rechters uiteindelijk ook minder geneigd zijn om snel te straffen.

      Het us echter duidelijk dat de academische opinie geen rekening houdt met bepaalde maatschappelijke bezwaren. Het is dus vooral aan hen om dit in te zien. Tevens moeten rechters natuurlijk wel beseffen dat hun doelgroep niet enkel de academische wereld is, maar ook de gewone burger. Er moet rekening worden gehouden met de waarden die gedeeld worden in onze samenleving. En het blijkt dat straffen in bepaalde gevallen wordt verwacht.
