      There is a case for this, as indeed trans people deserve their own protections, as indeed, discrimination against them can take unique and disgusting forms.

      So a woman who’s fully transitioned, who you have no way of knowing is trans or was “born a man”, can now be discriminated against for being a woman without protection from laws designed to protect women from sexist discrimination?

      How do people view this as a win?

      in the 90s people in these comments would be happy for laws like these hurting gay people, now in the 2020s theyre happy its trans people. The history books keep repeating themselves but in the end i hope progress will win.

      Waste of time and money. But at least it’s confirmed. By no means should anyone be nasty or mean to trans people. But a good decision and a victory for women

    8. I’m curious to know what defines biological sex.
      because gametes, genetalia and chromosomes are different things and there are disorders where not all of them align with the presenting gender.

      not to mention that we cannot do biological checks on people without violating their privacy , decency and health.

      I’m sadly not capable to comprehend what the court really ruled – I assume it’s a language barrier or the article is bad – or I’m stupid…

      So, did the court rule that a transgender woman with all the paperwork about changing gender from male to female is legally a woman and therefore has all women rights and protections or did the court rule a transgender woman is not legally a woman?

      The Supreme Court said its interpretation should not remove protection from transgender people, whether or not they have a Gender Recognition Certificate (GRC).

      It added: β€œTrans people are protected from discrimination on the grounds of gender reassignment.”

      The ruling also said trans women can claim sex discrimination because they are perceived to be women.

      A Gender Recognition Certificate is not required to give this legal protection.

      What do they mean by biological sex? Chromosomes? Uterus? Hormones? Lots of women are going to be arbitrarily excluded.

      So what happens when a trans woman is discriminated against for being a woman rather than for being trans?

      This is far more likely to happen than an imaginary pervert pretending to be a woman to get into toilets.

      All that’s happened here is FWS (the anti-trans group who launched this appeal) have pushed back what trans people have built so that they can gatekeep female identity: ironically, the most patriarchal thing they could be doing.

      If you actually read the ruling they also say that according to the 2004 act gender reassignment allows you to change your sex.

      So put that in your pipes and smoke it.

      I’ll post what I posted in another sub:

      I’m expecting a lot of pushback here, but I just don’t understand the need to further marginalise and demean some of the most vulnerable people in society. Trans, refugees, homeless, disabled. Why are these the people being picked on constantly by the press and public?

      This is going to result in women being put into men’s prisons and men into women’s prisons. Does nobody see that?

      A woman who has had surgery, pumped full of testosterones, has a dick, and is, for all intents and purposes, a man, is now going to be able to go into women’s spaces simply because they were born with XY chromosomes. It makes no sense.

      It also completely marginalises those who are intersex and were born with mismatching genitalia.

      Does this means that women who’ve transitioned into being men will be able to play women’s sports? Can they can join the Women’s Football team? Or are they just excluded totally from sports now?

      These people have absolutely no understanding of actual biology, sociology, or psychology.

      If they look like a woman, talk like a woman, and say they’re a woman – they should be legally a woman. Ditto for men.

      This begs the question, what is “biological sex?” There is no definition that would cover **all** AFAB people but exclude **all** trans women. Chromosomes, hormones, reproductive anatomy, all operate on spectrums as gender does.

      Regardless, it seems trans people are still protected under the equality act with this ruling.

      Well, when this was written it was most probably meant for biological sex or whatever you call it, so the ruling sounds right for me.
      That a solution should be found to also protect all gender identities (not sure whether the language is good here) is another topic.

      I wonder, considering the small number of trans people compared to the total population, whether it has a practical impact in this case.

      When they say biological sex, do they mean the physical features, the chromosomes or the hormones?

    18. Hopefully we’ll get to a point where sex reassignment can get so technologically complete that nobody can argue there even is such a thing as trans other than as a historical fact about the person.

      But we’re not there yet, and I’m pretty convinced that this is what creates 90% of these anti-trans movements. After that it’ll just be religious or very conservative people who have a problem for the simple reason that changing anything about your biology is against their ethos.

      Confirming what has been understood in other cultures with variations of non-binary gender perceptions for as long as they exist. Changing how you look visually does not make you into something you are not. What it does do is put you in a different category.
