Un senzatetto stava distruggendo i parabrezza delle macchine sulla mia strada con un cartello straordinario. È appena arrivato alla mia macchina quando stavo esaurendo, l’ho “fatto calmare” e ho chiamato la polizia. Si sono appena presentati, hanno raccolto il ragazzo, hanno scattato foto delle auto e sono partiti. C’è qualcosa che posso fare? Posso fare causa?

  4. You can sue. But as an old saying “you can get it from an empty pocket”…

    Get the car to a glass workshop that has a deal with your insurance. junited or Scheiben Experten are very common. You don’t need full Casco, Teil Casco will be enough. You pay appr. 200€, insurance pays the rest. Your SF is not affected.

    Jokes aside: You should have a “Teil/Vollkasko-Versicherung”. They normally also pay for vandalism. And yeah, if the police got the man, you can sue him. But to be fair: As he is homeless there is nothing to get.

    This highly depends on your insurance. You should file charges at the police and contact your insurance. Because the homeless most likely has no money even a successful legal proceeding won’t bring your money back.

    But if you have a “Vollkaskoversicherung” instead of a “Teilkaskoversicherung” your insurance will most likely pay for the damage minus any exceeds (Selbstbeteiligung)

    I share the opinion of my fellow posters. However, I strongly recommend that you report him to the Police. Especially if he has already been conspicuous before, this indicates that he needs help. But he can only get this if it is established that he is a danger to himself and his environment. Therefore: Report him to the police so that the incident is recorded.

    The police will refer the matter to the public prosecutor’s office. They will decide whether to file charges for property damage. Did the police take your personal details? They will then contact you and, if necessary, ask if you want to join the lawsuit as a joint plaintiff.

    But that won’t help you at all with the question of whether you will be compensated for your damages; that’s a matter for civil jurisdiction. First of all, you would have to demand that the person responsible compensate for the damage (yes, I realize they most likely don’t have the money, but no one here really knows that with complete certainty). If they don’t, then yes, you could sue, whatever the chances.

    But ultimately, everything becomes much easier if you have fully comprehensive insurance… Then you can save yourself all the hassle. It usually also pays for vandalism and then takes care of getting the money back from the person responsible. That’s no longer your problem.

    Is that really the society with rules that you brag about in Germany? Police should do something about it. OP did you check if your insurance can cover this?

    Youn can sue, you are very likely to win. That being said, you are very unlikely to get any money. Homeless people tend to have no assets, hence your claim will be economically worthless.

    Just make a claim at your insurance. The windshield is covered in the Teilkasko, so all you need to pay is either your Selbstbehalt or even less because most insurances work with companies that settle these claims fast and cheap. If you only have Haftpflicht… pay it yourself. You will not receive any money from a homeless person anytime soon

    And then the culprit gets found guilty and this above case gets covered. If not, you only get something when the culprit has money.

    OP is just copy pasting the same messages over and over. To me this whole story starts to look fake. Plus he has Aachen license plates and the police Aachen have not reported a case of car vandalism since many years (the last one was related to some random graffiti spraying of cars). If all this is true, a pasted redacted copy of the police report will prove that

    Call your insurance. If vandalism is covered, they will pay and sue him. If not, you can try suing but you won’t get much money.
