
Ciao, sto pensando di acquistare proprietà con mia moglie. Se il contributo di mia moglie non è tanto quanto me, deve pagare la tassa sulle donazioni. Come determinare il contributo reale come un importo che prendiamo dalla banca, quindi entrambi ripagiamo. Il suo contributo al rimborso non sarebbe superiore al 25%. Se qualcuno ha acquistato l’appartamento di recente, per favore guida? Ho già letto lo screenshot da Vero ma non sono sicuro di come determinare il contributo reale per ogni persona alla fine.

If you’re taking a loan that will be paid “somehow”, I wouldn’t worry about any gifts. Pay into a shared account and pay the loan from shared account.
So you would own 50/50 but will pay 75/25? I’m pretty sure that there’s no need for paying a gift tax in this case because you are allowed to pay your spouses bills. Just take one joint loan from the bank. But like every time with tax related questions, better ask Vero. They have a very good customer service.
Edit: Apparently I was wrong, making my suggestion of asking Vero even more relevant.
You want to buy the property 50/50, but you will be contributing more to the loan repayment than them?
I would probably contact and ask verotoimisto about it, but my naive conclusion would be that you would count how much extra you’re paying and count the amount of gift from that.
For example, if you in total paid back 20k€ in the first year, and the balance was you 15k€ and them 5k€, you could deduce that you gifted them ~~10k€~~ 5k€. You can deduct the 5000€ from this for the first year, and then you would have to pay the full amount on the following years, until you can deduct that again after 3 years.
Not sure at all about this though, just what I would guess.
Why not just buy the apartment 75/25? You dont have to have equal shares of ownership. Both can even take their own loans if you want.
