      Well… yes, of course they would.

      The Local Authority’s legal ground for the injunction to expel asylum seekers from the hotel is a breach of planning permission.

      The Government’s argument is that it has to provide people under its authority with somewhere to stay.

      The HRA argument is going to be the basic legal argument – that in balancing rights the local authority’s right to have a hotel be run as a hotel not a hostel against the individual human rights to humane treatment, the latter should win.

      Whether the court accepts it is a different question, but of course the Government is going to argue HRA issues.

    2. Labour going full mask off now. Not sure what they think this will accomplish; you could house the migrants in tents, they don’t have to be in that hotel

      I’ve voted labour all my life, I’m now genuinely starting to believe reform is the only option.

      You know that these hotels are sometimes paid up for years. I’ve seen that some of the Tory contracts were till 2029 and some can be terminated in September next year. That hotel in Epping is gonna be delighted if it’s paid for the next few years and gets to sit empty.

      While I’m sure that many of the deals could be repurposed for temporary housing for the homeless or whatever, who wants to bet that some won’t be.

      Another complete lie by the telegraph.

      No quote anywhere in the article says anything remotely close to the title of the article.

      This is literally just “as interpreted by the telegraph”

      If the home office win then there’s going to be a legal precedent set that allows people to challenge planning approval decisions on human rights grounds.

      Won’t take long for someone to try due the council when approval for their extension or loft conversions is denied arguing that it’s denying their right to family life by stopping their elderly parents being able to move in.
