Vengo dai Balcani. Ho pagato un’agenzia per fare il diploma Annerkenung e trovarmi un datore di lavoro in Germania, cosa che hanno fatto. Ma ora vogliono anche che io firma questo, il che mi sembra piuttosto assurdo. Potrebbero davvero farmi pagare 5000 € se Kündige ad un certo punto durante il mio lavoro?

I don’t see an issue with them offering contracts with such conditions. If you agreed to such a contract I cannot say.

Whether it is legally enforceable – either before or after it has gone through courts – I don’t know.
Just don’t go with an agency trying to put you into indentured servitude with so badly written contract clauses.
The way its worded is super bad. If by any means you fail you are supposed to pay. If that would be legally worded it would include a passus about selbstverschuldet.
Dont sign anything that rings an alarmbell.
