I think the best thing to do is just ignore the guidance and its proponents as much as possible and let them get swallowed in mountains of legal papers

IT’S LITERALLY YOUR FUCKING JOB TO DO EXACTLY THIS.
Trans people don’t just stop existing because the people running the EHRC really dislike us, and the point of contention that organisations are asking about is how trans people are meant to be accommodated in settings like the workplace. Falkner has a searing hatred and feels strongly that it is morally right trans people are not to use the spaces of their gender, but that isn’t the beginning and end of it. The EHRC itself has said since the ruling:
* Trans men should maybe be excluded from women’s spaces, in addition to men’s space
* Trans women must be excluded from women’s spaces, and what does it really matter if they don’t want to use men’s spaces
* Third spaces should maybe be provided, but only in the sense that trans people shouldn’t be left with absolutely nothing. What are the standards that third spaces need to meet? idk fuck you, you should have been doing them already. You don’t have third spaces that can be used currently and know what are your legal obligations for whether you need to provide them? fuck you not my job, I don’t care. Do trans people have a statutory right to use spaces for disabled people or is that an unlawful discrimination against disabled people? fuck you not my job!!! <3
* Organisations that want to operate in an inclusive manner can maybe do it if they have separate provision that comes together, e.g. a woman’s service and a service for trans people that come together and co-operate, but they may get sued by other groups if they do it in the wrong way (e.g. in the prior example, by cis men). What are the exact boundaries on lawful vs unlawful discrimination in this manner? who knows, not us at the EHRC! You should innately know though.
Not that things will get better with Falkner’s replacement, but my god is she so brazenly incompetent and incapable of separating her biases from her work.
I don’t know whats worse, that if implemented this would basically make being trans in public life impossible without being constantly outed or that everyone in any position of power is fine with that
The equalities watchdog is clearly led by militants and should be dismantled asap.
So when I use the mens I get harassed pretty much 100% of the time now because you know I’m a women, sometimes it is a backwards comment but i have had guysbget in my face and threaten to hit me especially if i have to wait for a cubicle, i get scared to use the women’s because I am scared some terf will record me and make my life hell for just going to the bathroom, iv had my female freinds pull me in when they see me trying to use the mens
Now I risk arrest if I use any bathroom so should I just piss in the street?
So we’ve gone from everyone knows what to do, its simple and there are no problems. To nobody knows what to do, make it up yourself, but fuck trans people especially.
I imagine again they will just ignore the issue of intersex people. People may think its not an issue but we have an estimated 1.1m intersex people in this country compared to about 250k trans people.
