If you want a legal person with experience of the issues on the panel that person is going to have worked for big tech. They are practitioners, not academics.
I do enjoy the Politico framing of this though – “confidential letter”, “seen by”, etc. to create the impression that this was some secret. It’s fairly clear that they got the letter through FOI.

Even seeming to be in a conflict of interest is inappropriate. The dullard denizens of the civil service then run and hide for cover behind title and process. The job should go to the applicant who challenged their smug complicity.
