Ciao a tutti. Una mia amica, nuova in Germania, mi diceva quanto sia orribile il suo lavoro attuale. Lavora in modo irregolare, a volte 50-60 ore a settimana come addetta alle pulizie. L’azienda ha mancato i pagamenti ed ha evitato le sue chiamate. Pensa anche che potrebbero non pagarle l’assicurazione medica e i contributi pensionistici.
So che non lo è d/destrama qualcuno può aiutarci a dare un’occhiata e verificare se questo contratto è legittimo?

the contract says she has to work 15 hours… why does she even agree to work longer when the contract clearly says 15 hours? she signed fo 15 hours so she works that amount. end of the story.

why would they for a 15 hour job? also how can you not know if you are paying contributions? it’s listed on every single payslip. and you choose the health insurance, it’s yours (except for geringfügige Beschäftigung maybe)

Why, though? Contract’s for 15h/week.
She needs to get a lawyer, she’s being exploited, especially since she’s not only working too much but also not getting paid for it.

That would be easy to check on her payslips. Or by asking her insurance. If they indeed don’t pay for these then she should report them at the Zoll (iirc they also handle social contribution fraud by companies)
Can’t find anything “off” at the contract.
But 15h / week if she is really working 50+, is obviously an issue. (And missing payments as well).
It sometimes happens with irregular hours , if she work a 50h, week, then has 2 free weeks.
Is she paid by hour? How are her working hours tracked ?

Make sure she gets payslips where everything is documented.
In case of sickness or vacation, the pay is calculated on the last 90 days worked. they will try to calculate it on 15 hours.

if the company does not pay it is a bad sign. Goto the arbeitsgericht and ask them for help. Ne need for a lawyer. They will help you out. Your pay is secured by the german state for 3 month in case they go broke.
