Il parlamento olandese vuole fare causa alla Slovacchia per la sua modifica costituzionale

Translation: The Kingdom of the Netherlands could sue Slovakia before the European Court of Justice over the recent amendment to the Slovak Constitution.

This follows from a resolution adopted by the Dutch Parliament on October 16. In the resolution, the Parliament refers to Article 259 of the Treaty on the Functioning of the European Union, which states that “a Member State which considers that another Member State has failed to fulfill an obligation under the Treaties may bring the matter before the Court of Justice of the European Union.”

A group of MPs mention in the resolution the Slovak constitutional amendment that placed national law above EU law and restricted the rights of LGBTI people.

“We convinced the Dutch Parliament to support our proposal, and we hope that the Court will stop Fico’s violations of LGBT rights and our shared European freedoms,” said Laurens Dassen, the proposal’s sponsor and an MP for the liberal Volt party, in a statement to the Slovak daily SME.

“Every European should have the freedom to be who they want to be. But populists are undermining our European freedoms, and the old parties no longer have the courage to stand up for a common European future,” he added.

The Dutch Parliament itself cannot sue Slovakia, but through the resolution it calls on the government to file such a lawsuit.

The Treaty on the Functioning of the EU stipulates that before submitting a lawsuit, a Member State must first bring the complaint before the European Commission, which is to hear the positions of both states in an adversarial procedure.

why tho , the EU hasnt passed any laws on LGBTI , their is no EU level law in terms of LGBTI , ( from what i remember poland vetod any discussion of it ) the dutch has no legal ground to sue if they claim it breaks a treaty

honestly its none of the dutch parliments business what other countries do to their constitutions
