This is honestly such a scam and I’m surprised it’s gone on for as long as it has with no end in sight.

One of the reasons I got a seperate airtime contract and bought a good refurbished phone on credit. Can be more expensive in the short term depending on the phone but if you can afford the expense, dont upgrade phones every couple of years & keep an eye out for deals on the deal websites its worthwhile.

Whilst it is clearly a scummy business practice to spread the phone cost over 24 months, but then keep on charging it if the user doesn’t buy a new contract with new phone, I fail to see how it is illegal.
What law is broken exactly?
Would the same apply to broadband routers where you get one when you sign up, but might keep the same router for 5 or more years even though the minimum term was 1 year? You don’t expect a discount in month 13 onwards…

The core claim of the lawsuit is that mobile companies continued to charge customers for a bundled plan, including a handset that had already been paid off, long after the minimum contract term ended.
I can see the above being an issue for the less tech savvy or older generations who may not have set up their own contracts relying on children or grandchildren.
I can think of a couple of times in the last 10 years where I’ve finished a contract and haven’t switched provider and have had to ask to be moved to the sim only plan months later, recovering the cost would probably be no more the £50 but it’s better than nothing.

I’m surprised these phone companies didn’t have something in the small print of the contract that says “at the end of your contract we will continue to charge you the same monthly amount even though the device is paid off” to cover themselves here.
