True story and luckily I had necked the yokes earlier on in the night.

That’s why it’ll never be decriminalised. If it was legal, they wouldn’t have an excuse for random searches.

Ridiculous the time and effort spent on someone smoking a spliff, yet I can fall around legless after eight pints and apparently it’s great craic.

>It is absolutely essential to emphasise the following point: if the real reason a search is being conducted is suspicion of a crime other than cannabis possession, then that search is unlawful,” Ó Concubhair will say in his opening statement.
Not if there is a smell of weed.

“He cites the example of shoplifting and says that a reasonable suspicion by gardaí that someone has shoplifted does not grant a power to search that person, a situation Ó Concubhair describes as an example of the “curious and problematic gaps” in Ireland’s policing regime.”
If that is the problem, then its an easy fix….

I could often tell the car in front of me had someone smoking it while driving. I imagine its as obvious for the guards on the roads too.

I mean, this isn’t news.
Using suspicion of possession to try find evidence of worse crimes was something the the assistnant Garda Commissioner – now top Garda Commissioner – Justin Jelly, highlighted as a reason against decriminalization during the citizens assembly on drug use.
It’s not even an open secret – unlawful searches was practically presented as a positive by him, and openly said to the country three years ago
Edit: It was actually Dept of Justice, Ben Ryan who argued for using the excuse of searching for drugs to find evidence for other crimes related to larger quantities of drug supply. Justin Kelly just agreed that the power should be not diminished,.and that it is used on a daily basis by all gardai units, even those outside of drug units.

Years ago my house was raided because during a traffic stop the garda saw ripped Rizzla packet. We smoked rolling tobacco at the time. In fairness they were really nice and just knocked on the door to gain entry. No screaming or shouting or that sort of stuff. They seemed resigned that they had to do it with zero effort or enthusiasm. And no they found nothing.

A Garda searched my car before and found a literal blade of grass from the field. He was so certain it was weed and was smelling it and all.
Now we did actually have grass on us but it hadn’t been in the car (my friend met us at the park for football). It was obvious he was looking for excuses to search us more thoroughly.
This was probably 15+ years ago but they’d search your car for nothing back then.

Good honestly, the amount of this shit around the place has gotten out of control since covid. The absolute reek off it everywhere and they dont even try to hide it anymore, just walking around down town smoking it.
