Ciao ragazzi, l’anno scorso ho vissuto in un appartamento con altri 2 ragazzi per 6 mesi a Francoforte. Ho pagato 615€ per il primo mese e nei successivi 5 mesi ho pagato 15€ in più perché l’inverno stava arrivando. Ora che ho lasciato l’appartamento e il proprietario mi avvisa con un’e-mail che abbiamo usato troppa elettricità (anche i nostri riscaldatori sono elettrici) e che tratterrà l’intero deposito (1000 €). Ho controllato nella fattura allegata che le spese indicate per l’intero anno mostrano che i 6 mesi in cui non ho affittato l’appartamento sono paragonabili ai restanti 6 mesi, il che mi sembra strano. E sta cercando di farmi pagare per tutto l’anno. Potresti dirmi se c’è qualcosa che posso fare al riguardo? Ps: il mio contratto dice che tutti i costi sono inclusi nell’affitto

      Yes, even electricity and heating was included in the lawful rent. It looks like this is a scamlord. Get a lawyer.

      The 15 Euros extra from October 1 might be illegal because rent can only go up once a year. Check with a lawyer.

      So if the first this is a part of your old rental contract I think he can’t keep it but you need to take actions I guess.
      I am not a lawyer and don’t have knowledge but I would send him a “Einschreiben” letter with tracking with something written in there like:
      You have 24 days to get me the deposit back else I will take some legal actions. The contract included heating and electric bills so you can keep my money.

      Not sure if that is true I would research a bit and then send this. If you have the right to do that you could also start a “Mahnverfahren” after the 14 Days and tell him in the letter that you will do so if he will not pay you back.

      The contract that you posted seems pretty clear to me that all additional costs except internet and telephone are included.

      Send a letter to the landlord, with tracking, and just say something like this https://kautionsfrei.de/assets/files/rueckzahlung-der-mietkaution_anschreiben-vorlage.pdf

      If they fail to do so then contact either a lawyer or the local tenants association.

      Ignore any emails, WhatsApp’s, or similar they might send – only recognize letters. Don’t engage in back and forth discussions. Stay professional and polite.
