
La vittima ha riportato gravi lesioni. Il giovane ha commesso il reato nell’agosto 2020 durante il periodo di prova di una condanna imposta dall’ufficio del procuratore minorile. Dopo l’apertura del procedimento penale, il kosovaro ha commesso ulteriori reati.
La corte suprema svizzera ha confermato che sussiste un caso di difficoltà personale. Tuttavia, l’interesse pubblico all’espulsione prevaleva su quello dell’imputato. La gravità del reato e il pericolo rappresentato dall’imputato erano importanti. C’era anche un rischio rilevante di recidiva.
Un altro punto sollevato dalla corte era che il giovane non era economicamente integrato. Nonostante la minaccia di espulsione, non era riuscito a entrare in un rapporto di lavoro stabile.
