What he says is actually true. This is not just hate speech against minorities, at least half of the European countries have crimes such as insulting the head of the state, insulting citizens, insulting politicians, insulting the flag or burning the flag, insulting religious values in their penal codes. You may say that these are generally not applied, but there are examples where they are applied, and even if they are not applied, as long as they are included in the penal code, any prosecutor or judge can apply them whenever they want.
