
Ciao a tutti, di recente ho chiesto una riduzione dell’affitto, in seguito alla recente diminuzione del tasso di interesse. Quello che ho ricevuto invece è un aumento dell’affitto di 150 CHF "A causa di locali e quartieri"
Perché è così e come posso difendermi contro questo? Sembra totale non senso per me

This can be challenged and will likely thrown out.
Most likely because they did not increase your rent completely when rates went up and they kept it in reserve. Now that you asked for a reduction, they passed on the increase they should have passed on „minus“ the reduction
In other words I believe you never got a full rent increase in first place. Right?
Most people got rent increases in range of 8-12% last year. Not sure how much you got
My thinking is the following
X was old rent,
Y was expected rent after rates went up, Z was rent they actually applied to you, Z* new rent
Z < Y
And
Z* > Z
this country needs a revolution
I assume they mentioned that in the rental contract (vorbehalt nicht realisierte mietzins reserve). Check the contract. It means that they rented the apartment to you for less than they had to. But if they didnt mention orts- und quartier üblichkeit explicitly it wont hold up in court

The Mieterverband had warned about this

It depends. As the tenant, you may legally assume that the starting rent is customary for the location, unless it’s explicitly stated otherwise and they reserved the right to increase it later. Check your rental agreement. Another possibility is if a significant amount of time has passed since the conclusion of the agreement. Apparently that’s around 6 years.
Last thing to check is if the rent increase is actually in line with the overall increase in rents in your neighbourhood.
If one of the first two as well as the latter condition apply they may well be allowed to increase your rent.
Where is the increase here? I only see a reduction of -62.- and the 213.- are ‘vorbehältlich’ so not yet realised..

Your landlord cited the letter of the law right in there, it’s [article 18 VMMG](https://www.fedlex.admin.ch/eli/cc/1990/835_835_835/de#art_18) they are referring to.
That article states that if there are rent increase reserves the landlord could legally charge but does not yet charge (Vorbehalt), these have to, by law, be stated in exact figures.
As they are doing here: CHF 213.- “vorbehältlich ***noch*** ***nicht*** **realisierte** Mietzinserhöhungsreserven aufgrund Orts- und Quartierüblichkeit”.
They have to put these “not realised” figures into contracts (meaning it should be in your contract, where you should be able to check; unless it’s a very old contract, in which case it’s a bit more complicated).
If you’re a member of Mieterverband, or if you have legal insurance, now would be a good time to get their input on how realistic your chances would be if you took your landlord to [Schlichtungsbehörde](https://www.mieterverband.ch/mv/mietrecht-beratung/ratgeber-mietrecht/unterlagen-tools/schlichtungsbehoerden.html) over this.

Way too much sneakiness n confusion. Thats how they get you. Unfortunately its all over CH. Hence why i left and extremely happy to leave that country!!!!
If your building is older than 10 years and has been owned by your landlord for less than 30 years orts und quartiersüblichkeit is not relevant and a bullshit excuse for an illegal rent increase.
Gosh now I am scared, asked for rent reduction myself lol
