Così ho recentemente affittato uno studente KOT nella regione fiamminga. Non l’ho visto prima di noleggiarlo, e una volta arrivato ho notato che l’appartamento aveva molti problemi. L’odore era molto cattivo, quasi simile a quelli delle acque reflue. Ci sono stati danni all’acqua e ho trovato una sorta di uova di insetti morti vicino alla porta. C’era anche una piccola area nel muro dove le formiche stavano mangiando in qualcosa. Il letto era macchiato e c’era muffa attorno alla lista lungo le pareti. Ho pagato solo metà del deposito prima di vedere il posto e ho detto al proprietario che non posso vivere lì e ho restituito la chiave mentre cerco qualcos’altro. Ora ho perso circa 500 € dal momento che non vuole rimborsarlo perché si sente ingiusto per lei che ho rinunciato alla stanza quando avrebbe potuto affittarla a qualcun altro. Secondo il contratto, ha il diritto di chiedere 2 mesi di affitto come penalità poiché non ho dato un preavviso precedente. Non me ne ha ancora menzionato, ma ho paura che lo richieda più tardi comunque. E sul deposito, ho il diritto di richiedere l’intero importo? Ho allegato alcune foto del posto.

it’s dirty and poorly maintained, but i don’t see anything that in itself is a reason to void the contract.
If you want to find good reasons to cancel the contract, you’ll need more serious stuff, like:
– not having roof insulation
– ‘enkel glas’
– wet spots and mold problems that are not caused by lack of ventilation
– heating that uses gas & has ‘enkelwandige schouw’
There are the big hitters in getting the appartment approved for the “Vlaamse Wooncode”, fail on enough of these and the contract is void because it’s not suitable to be rented out.
Why didn’t you see the place before you signed? This is crucial before you sign contracts like this.
Say that if she doesn’t give the 500€ back you will contact the communal administration with all your pictures. Talk about the mold, the insects, ask if the apartment is in electrical compliance. It’s illegal to rent unsanitary housing.
I know I would rather pay back 500€ than having to face any of these issues with an administration.
She won’t be able to make you pay more, just refuse and if she goes to court, which she will never do, you can defend yourself with your proof. And she will certainly not go to court because that would mean risking you to show how disgusting the place she tries to rent is.
