

Ciao a tutti, sembra che la mia prima multa in Germania sia qui … è per guidare troppo vicino all’auto di fronte.
Sfortunatamente non ricordo molto di questo incidente, solo in base alla mia memoria approssimativa il traffico era troppo denso e il limite era 100 su Autobahn. Non ricordo cosa sia successo esattamente dal momento che sono oltre 50 giorni dall’incidente …(
Ho ricevuto questa lettera e chiedono di fornire una spiegazione (almeno questo è ciò che ho capito) o non di rispondere e mi aspettavo solo una multa.
Qualcuno di voi ha sperimentato questo caso? Se sì, c’è un modo per uscire dalla multa spiegando la mia situazione?
Inoltre, il peggior cast quale sarebbe la multa? Posso aspettarmi un divieto di guida per alcune settimane?

No, they already mention that if you don’t reply / don’t contest you’ll receive a monetary fine (Geldbuße).
Just to get that out of the way.
Normally it’s not recommended to reply without the help of a lawyer, since you could further incriminate yourself. e.g. by admitting that the traffic was too dense you’ll admit having noticed it and *still* drove too close, which upgrades your ticket from accidental to deliberately, which can quadruple the amount and tack some driving ban on.
So your best bet would be to either ignore and eat the fine, or find a traffic lawyer to review the evidence and try to contest it.

Very unlikely. The only two ways to get out of such a fine is “it was a life or death emergency situation”, and “you measured wrong”. And the burden of proof is on you in those cases, because they already have the evidence of the measurement. (Or well, the “It wasn’t me driving”, but then they will ask you to testify on who you gave access to your car)

Then your expected course of action is slowing down until there is enough distance to the car in front. 100 is the speed **limit** not the mandatory speed.
AFAIK you can expect a fine of €75 and one penalty point on your licence.
I’m not sure what your “situation” is: at the speed you were driving you should have been at least 40 metres away from the car in front, and you weren’t. That’s because if the car in front has to brake for any reason, you must be able to stop without hitting it; it doesn’t matter that traffic was dense, it’s basic road safety. You do of course have the right to dispute the fine, but unless it wasn’t you driving and you can name the actual driver, I don’t think you’ll be able to get out of the fine.
Well you could provide an explanation, but only a “life or death” kind of situation may get you out of a fine, if you can provide evidence. You could also argue that you were not the driver, and don`t recognize the driver, but that may result in an obligation to keep a driving log, and you don´t want that.
Just pay the 75€ or 100€ fine and go on with your life. Everyone is driving too close, but it`s the law.

I often feel there is a car breathing down my neck at the autobahn when I am driving with the speed limit, such fines are a very welcome change on my part!
ADAC site says, since you where below 100kmh and the letter states 5/10, it should be 75€, 1 point. No driving ban. Plus some processing fee probably.

<5/10 halber Tacho Abstand and over 80 but below 100 kph is including aministrative fees 103,50€ and 1 point (unless you are in Probezeit for your license that should be no big issue.)
If you are in Probezeit though you will be asked to and attend an Aufbauseminar arround 500€ for the course as following way too close is an A-Verstoß like being flashed on a Red.. And the Probezeit will be extended to 4 years… Or face disqualification if you don’t attend the Aufbauseminar that is.
