Siamo studenti internazionali in un WG con una società privata come proprietario. 6-7 mesi fa la nostra vasca da bagno e la doccia e il tubo del lavello della cucina (tutti hanno lo stesso gasdotto) si è intasato e l’acqua non scorreva attraverso i tubi. Ci siamo lamentati con il proprietario e hanno inviato un lavoro idraulico di emergenza che ha lavorato per soli 10 minuti e il proprietario ci ha accusato circa 500 €.
Lo stesso problema è successo di nuovo 2 settimane fa e ci siamo nuovamente lamentati con il padrone di casa. Per prima cosa hanno chiesto un deposito di 300 € e hanno detto che invieranno l’idraulico dopo. Non abbiamo risposto a questo e il giorno successivo il vicino che vive sotto il nostro appartamento si è lamentato con il proprietario che il suo soffitto sta perdendo. Questo problema è stato anche lì l’ultima volta che il nostro bagno si è intasato. Dopo la denuncia, il proprietario ha inviato lavori idraulici di emergenza e hanno lavorato di nuovo per soli 10 minuti. Ieri hanno inviato la fattura della fattura e un Abmahnung affermando che dovremmo pagare un importo di circa 600 € per i lavori idraulici. Lo abbiamo ricevuto il 1 ° ottobre, la data di Abmahnung era il 18 settembre e hanno chiesto i soldi prima del 2 ottobre. Hanno anche dichiarato che il tetto dei vicini ha bisogno di lavori di riparazione e se la compagnia assicurativa non li ha pagati dovremo pagare anche l’importo per la riparazione. Cosa dovremmo fare?
È chiaramente dichiarato nella fattura di aver lavorato nella conduttura principale dell’edificio e anche ci stanno caricando per l’impianto idraulico di emergenza.
Abbiamo risposto a loro chiedendo le prove che abbiamo fatto l’intasamento e anche la data in cui hanno inviato la lettera. Abbiamo anche detto che non pagheremo i soldi

Well the note from the plumber says that the pipe was blocked because of fat from a kitchen. If that is really the case and this was from your kitchen then yeah, i am afraid you will have to pay for this. Also interestingly enough the note says that the water was flowing out of the lamp of your neighbor, that could have been really dangerous.
Depending on where you guzs live you could search for the Mieterschutzbund in your area and go there, you pay a price and get legal counseling, but as u/emanon_noname said, the note says that it’s clogged because of fat so maybe you guys are doing something bad and are not noticing it or are not cleaning properly?
I would also ask the neighbours if they have similar problems.
Did you use drain cleaner between these incidents?
The plumber wrote that there was a lot of fat in the pipes. Any explanation for that?
I don’t know if this is the case here, but we had neighbours who dumped their frying oil down the drain. The pipes would clog up pretty quickly, and water would pour out of every opening.
But if you’ve never done that, the pipes were probably too narrow otherwise.
You won’t get out of this without a lawyer.
I’ve dealt with a very similar issue myself. Unfortunately, it’s quite common in Berlin for landlords to misrepresent things and to bring in their own plumbers or contractors, who often act in the landlord’s interest rather than being objective. From what you describe, I don’t believe you’re responsible for this cost, they’re likely trying to push an expense onto you that they should be covering themselves. You can simply tell the landlord that if they insist, they’ll need to take the matter to court. Also, it’s a good idea to have liability insurance, since it’s exactly for these kinds of disputes and potential claims, if things escalate.
They charge for cleaning less than 5 meters of your pipe (Anschlussrohr) but also 12 meters of presumably shared pipe (Fallrohr). I’m no expert but I would assume if only your part of the pipe is blocked, it wouldn’t affect the shared pipe? And if the shared pipe was blocked, it could have been caused by your neighbours too?
