      >The court was told he arrived at a Chinese on North Queen Street in an agitated state and asked for food without having the money to pay.

      >A witness who was working at the business said: “It was late, and this fella in his 20s, wearing a tracksuit, came in screaming and shouting about getting a munch box, but he didn’t have any money.

      >“He became aggressive and tried to smash the glass on the counter. He threatened to wreck the place.

      >“He beat one of the Staffies with a dog chain he had on him.

      >“He has been coming in for years, and we’d never had any problem with him before.”

      >Defence counsel disputed the claim Porter had hit a dog with a chain, noting the witness had not mentioned it in her statement.

      >The court was shown CCTV footage recorded outside the takeaway which showed the defendant walking in and out of the premises, both times in an erratic fashion.

      >The clip also shows two Staffordshire bull terriers following him before he turns on one of them, kicking the animal on its right side.

      >Porter’s solicitor said there was no definitive evidence before the court to show the defendant had kicked the dog.

      >They added: “It’s down to interpretation of the video. It’s not clear that contact is made with the animal. The dog appears to move out of the way.

      >“This is about whether or not he actually kicked the animal, and we say you cannot be sure beyond reasonable doubt. Regardless, he is ashamed of himself.”

      >The court heard the defendant had “no recollection” of the incident, and that when it was put to him in police interview, he said: “If it’s on CCTV, then yes (I did it).”

      >The footage is understood to have left Porter, of North Queen Street, distressed.

      >Convicting him of the offence, Deputy District Judge Austin Kennedy said he had “no doubt” the defendant kicked the dog.

      >He added: “It’s put to him in interview, and he shook his head, saying it wasn’t intentional and he didn’t mean to cause suffering to the animal.

      >“On viewing the evidence, I have no doubt whatsoever he did, and there will be a conviction.”

      >It was also revealed that Porter was in breach of an eight-month suspended sentence for unrelated criminal damage imposed in February.

      >As such, sentencing was adjourned, pending the compilation of probation service reports.

      >Releasing the defendant on bail until November, Deputy District Judge Kennedy told him: “You should cooperate fully with probation as your liberty is at risk.”

      Does anyone generally carry a dog chain with them without a dog? Seems to me he was looking for trouble.
