*How sickening it must be to sit through that evidence for the family and friends of the victims that died.*

Counsel for bereaved husband and father Ryan Smyth was questioning crash scene investigator Damien Coll when the phone records were produced.

He put it to Mr Coll that at 16.45pm and 45 seconds, eight to nine seconds before impact, Mr Wilkinson’s phone accessed Instagram, asking whether that would have impacted the driver’s ability to avoid collision.

“Yes,” Mr Coll responded, later adding: “Concentration can be taken away from the normal driving task, which can result in not perceiving a hazard ahead.”

Mr Wilkinson denied use of his phone.

Audio taken from a cow shed across the road from the scene of the accident was played in court.

In the audio, a vehicle can be heard travelling along Whitepark Road, followed by what was said by Mr Smyth’s counsel to be “a high-pitched scream from a woman’s voice” from Mrs Smyth immediately before impact.

Clearly a horrific incident, and no excuse for scrolling Instagram while driving a tractor- But also a heartbreaking reminder that you shouldn’t be driving a quad bike with a 5 and 3yr old.

This behaviour is so rampant now, every time I’m on the M50 I’ll see stupid cunts with the head down scrolling on their phones doing 100mph. It absolutely boils my blood. There should be a complete zero tolerance policy to phone use while driving, if you’re caught on your phone it should be an automatic 3 month driving ban at least, no exceptions.

RIP to that woman and her poor child.

We need this kind of information for any accident and anyone using their phone while driving should facing serious consequences and any doing it resulting in people dying should be locked up for a long long time.

This behavior is rampant I see people every day on their phone, the amount of lads in tractors on back roads it’s an epidemic and shit is only going to get worse

I cycled past a woman in a Beamer jeep in Rathmines this evening with a period drama, something like Downton Abbey, playing on her phone, which was leaning against the middle of the dash. She signalled that she was just listening, not looking.

      Listening my arse.

As emotive as the title is I would question how anyone could dare to claim to be this accurate with the timing of a crash let alone use it as an argument in court. Even with two different time sources, a camera and a phone, the difference could easily be enough for someone to have full attention on the road even if they had looked at their phone earlier.

Time stamps in apps and how they are generated are also an entire world of their own on top of this that we don’t even need to get into but something like this is being portrayed as cut and dry when it could very well not be.
